FUNDACIÓN BRINGAS-HAGHENBECK, I.A.P., (hereinafter FUNDACIÓN), committed to the protection of your Personal Data, assuming responsibility for its use, handling, storage and confidentiality in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals (hereinafter THE LAW) and in order to inform you about the main characteristics of the treatment to which your Personal Data will be subjected, issues the:

COMPREHENSIVE PRIVACY NOTICE

In compliance with the provisions of LAW, we wish to inform you as follows

I. Responsible party that collects your personal data.
THE FOUNDATION is responsible for the processing of your personal data in terms of the provisions of article 3 section XIV of THE LAW.

II. Address of the person responsible for collecting your personal data.
THE FOUNDATION has its address at Av. Hidalgo N° 9, local 17 (upper floor), Colonia Del Carmen, Alcaldía Coyoacán, C.P. 04100, in this city.

III. Principles.Your Personal Data will be treated based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility in terms of the Legislation. The confidentiality of your personal data will be maintained by establishing and maintaining effective administrative, technical and physical security measures to prevent its damage, loss, alteration, destruction, use, access or improper disclosure.

IV. Personal Data collected and subject to processing by THE FOUNDATION
THE FOUNDATION, through its general offices, its educational and welfare centres that comprise it, which are: (i) Luz Bringas Preschool, (ii) Maella Chalco Kindergarten, ( iii) Luz Bringas Primary School, (iv) Luz Bringas Secondary School, (v) San Lorenzo Community Centre, (vi) Maella Chalco Health Education and Recreation, ( vii) Las Magnolias Residence; ( viii) San Francisco Residence (ix) Teodoro Gildred Residence; may request the following general personal data from you: Name, Address, telephone, email, age, sex, place and date of birth, Federal Taxpayers Register (RFC), Unique Population Register Code (CURP), academic data, employment data, data of minors.

On the other hand, as a result of the legal relationship that may be established between THE FOUNDATION, the educational and/or assistance centres that comprise it and you or your relatives, personal financial and property data may also be required in terms of article 8 of THE LAW, as well as data considered as sensitive in terms of section VI of article 3 of THE LAW, such as a) biometric data, b ) health data, c) data of persons with disabilities, d) religious beliefs.

In compliance with the provisions of article 9 of LAW, we inform you that in order to collect and process your sensitive data, it is necessary to have your express consent, so that at the time such information is collected, we will ask you to indicate whether or not you accept the processing of such data.

It is the responsibility of the Data Subject to ensure that the information provided to THE FOUNDATION is accurate and complete, and therefore, he/she must communicate any changes in it in order to comply with the obligation of accuracy and updating of his/her personal data.

V. Safeguarding of Personal Data.
The information provided to THE FOUNDATION will be duly safeguarded, preserved and protected with the appropriate technological and physical means in order to prevent its loss, misuse, alteration, unauthorised access and theft. Only strictly authorised persons will have access to the information, whether employees or service providers, who have assumed the commitment to keep the information under strict confidentiality and security. In the event that the personal data stored is required by an authority of any kind, whether by legal process, to respond to any claim or legal action, or to protect the rights of THE FOUNDATION, this data may be made available to them in strict compliance with the law.

VI. Purpose of the processing and personal data collected.
In accordance with the provisions of Article 16 of THE LAW and Articles 26, 27 and 28 of the Regulations of THE LAW, we inform you that the personal data mentioned above will be used by THE FOUNDATION, through its general offices, its educational and assistance centres that comprise it, for the following purposes:

General Offices
1. For the contracting of a service.
2. For the conclusion of a lease contract.
3. For the receipt and/or delivery of a donation.
4. For the process of recruitment and hiring of personnel.

Educational Centres
1. For the provision of educational services at the basic level (preschool, primary and secondary), that you and your children require, in any of our educational centres: i) Luz Bringas Preschool, ii) Maella Chalco Kindergarten, iii) Luz Bringas Primary School, iv) Luz Bringas Secondary School, in accordance with our corporate purpose.
2. Publication of information related to our academic events, calls for applications for programmes run by our educational institutions.
3. To offer information and scholarships offered by THE FOUNDATION.

Care Centres
1. For the provision of assistance services for community development required by you and/or your relatives in any of the assistance centres of THE FOUNDATION, i) San Lorenzo Community Centre, ii) Maella Chalco Health, Education and Recreation Centre, in accordance with our corporate purpose.
2. For the provision of home care services, accommodation, food, clothing, occupational activities and medical care and attention services to elderly people, required by you and/or your relatives in any of the Foundation's care centres, i ) Residencia Las Magnolias; ii) Residencia San Francisco; iii) Residencia Teodoro Gildred, in accordance with our corporate purpose.

In general, to send information and communication between educational and welfare centres that make up THE FOUNDATION, as well as with federal or local, health, tax and labour authorities, as required, and between their families and those responsible for them, for example, in the event of an emergency.

The general and sensitive information we collect from you will not be used for advertising, marketing and/or commercial purposes, or for any purpose not stated in this notice.

We undertake not to transfer your personal information to third parties without your consent, except for the exceptions provided for in art. 37 of the Federal Law on the Protection of Personal Data Held by Private Parties.

VII. Acceptance or opposition to transfers or refusal to process personal data
If you do not express your opposition to your personal data being processed and, where appropriate, transferred, it shall be understood that you have given your consent to do so and such consent shall be valid for all purposes arising from the contractual relationship.

VIII. Procedimiento para dar atención a las Solicitudes de Revocación y de Derechos de Acceso, Rectificación, Cancelación y Oposición (ARCO).
Conforme a lo señalado en LA LEY, usted podrá solicitar el acceso, la rectificación, la cancelación (en caso que ésta sea legalmente procedente) u oponerse al uso de los datos personales que hayan sido proporcionados al responsable, o revocar el consentimiento que haya otorgado, en un plazo de 5 días hábiles después de haber otorgado su consentimiento al presente Aviso de Privacidad, a través de la dirección de correo electrónico zortiz@fbh.org.mx, su solicitud será atendida por nuestra encargada Srita. Zaira Itzel Ortiz Mino, dicha solicitud deberá contener e incluir lo siguiente:
1. El nombre completo del titular y su dirección de correo electrónico en que desee recibir la respuesta a su solicitud.
2. Una descripción clara, precisa y específica de los Datos Personales respecto de los que se busca ejercer alguno de los derechos mencionados, así como el detalle de cualquier elemento o documento que facilite la localización de los datos personales.
3. Copia legible de una identificación oficial vigente del titular y, tratándose de un trámite llevado a cabo por un representante legal, se deberá adjuntar adicionalmente el instrumento público correspondiente, o bien, una carta poder firmada ante 2 testigos, así como una copia de la identificación oficial vigente de apoderado legal.<br<> 4. En el caso de un Derecho ARCO de Rectificación de Datos Personales, se deberá adjuntar la documentación que sustente la solicitud.
5. Una vez presentada su solicitud, LA FUNDACIÓN podrá solicitarle en un periodo no mayor a 5 días hábiles, la información y/o documentación necesaria para su seguimiento, así como para la acreditación de su identidad, de acuerdo a los términos que marca la Legislación. Por lo que usted contará con 10 días hábiles posteriores a su recepción, para atender este requerimiento, de lo contrario su solicitud se tendrá por no presentada.
6. En un plazo posterior de 20 días hábiles LA FUNDACIÓN emitirá una resolución, la cual le será notificada por los medios de contacto que haya establecido en su solicitud. Una vez emitida la resolución y en caso de que la misma sea procedente (parcial o totalmente), LA FUNDACIÓN contará con 15 días hábiles para adoptar dicha resolución.
7. Los términos indicados en los párrafos anteriores, podrán ser ampliados una sola vez en caso de ser necesario y se le deberá notificar a través de los medios de contacto que haya establecido.

IX. Complaints and claims for improper processing of your personal data.
If you consider that your right to protection of personal data has been violated, or if you presume that in the processing of your personal data there is any violation of the provisions set forth in THE LAW, you may file the corresponding complaint or denunciation before the National Institute of Transparency, Access to Information and Protection of Personal Data.

X. Changes to the Privacy Notice.
This Privacy Notice may be modified or updated at the discretion of THE FOUNDATION in terms of the applicable regulations, any modification and/or update to the same will be communicated by the responsible party through the publication of the new Privacy Notice on the website fbh.org.mx/privacy_notice.

XI. Duration for the conservation of personal data.
The Personal Data that you have provided us will be kept for a period of up to 5 years in physical and/or electronic media, after the conclusion of the contractual relationship; in the event that a new transaction is carried out, the retention period will be renewed for the aforementioned periods and will subsequently be discarded in order to avoid improper processing of the same.
